- [Rehearing](https://www.mdcomplaw.com/glossary_term/rehearing/) - Parties may request a "rehearing" within 15 days after the award date on the grounds of error of law or newly discovered evidence. The Commission may, but is not required to, grant a rehearing, when requested.

- [Part Time](https://www.mdcomplaw.com/glossary_term/part-time/) - Employment that is not considered full-time. If a claimant is injured while working a part time job, the wages received for that employment are used to calculate the average weekly wage, not the wages from both a full time and part time job.
- [Overtime](https://www.mdcomplaw.com/glossary_term/overtime/) - Compensation received, in addition to regular wages, for working more than 40 hours in a seven-day period. Overtime may be considered when calculating the employee's average weekly wage.
- [No Fault](https://www.mdcomplaw.com/glossary_term/no-fault/) - The workers' compensation system was created based on a "no fault" system of recovery. Simply stated, an injured worker may recover even if the worker was negligent, because the Workers' Compensation Act does not assign fault to either party.
- [Nature and Extent](https://www.mdcomplaw.com/glossary_term/nature-and-extent/) - To be compensable, an injury or illness must be die to a hazard inherent in the nature of the workers' employment generally. The extent of the injury is calculated upon the principles of permanency.

A claimant must file to reopen a claim within 5 years of the date of last compensation, or they are barred from reopening their case for modification.

Generally, the insurer/employer will file Issues contesting causation or compensation. The claimant will file Issues regarding permanency. The filing of Issues with the Commission will cause a hearing to be scheduled to address any points of contention between the parties.

Examples of interlocutory orders include orders permitting an amendment of a claim or allowing a claim to be scheduled for a hearing on the grounds that it was not barred by the statute of limitations.

The two-year statute of limitations period does not begin to run until the day the employer files the Employer's First Report with the Commission.

When calculating death benefits, the Commission must make a determination of which people are considered dependents.
- [De Novo Trial](https://www.mdcomplaw.com/glossary_term/de-novo-trial/) - Literally translated to "beginning anew." If a claimant files an appeal of the Commission's decision to the Circuit Court, the trial on appeal is essentially de novo and the parties are not confined to only the evidence that was submitted before the Commission.
