Is My Employer Entitled to See My Medical Records in a Comp Case?

This is actually not a simple answer.  Your employer is not entitled to any records.  Often, the workers’ comp insurer is entitled to see some medical records.  If there’s a prior related condition, the insurer can generally get those records.  If the claimant doesn’t consent, then employer will subpoena the med records.  This will likely mean the claim will be contested until the insurer can get those prior records.

If this is the kind of question you’re asking, you should certainly have a workers’ comp lawyer.  If you’re in Maryland, we can advise you further.  If you are elsewhere, we can refer you to a good comp lawyer.
