South Dakota workers’ compensation is governed by the South Dakota Department of Labor and Regulation.  Employers can either purchase workers’ compensation coverage from third-party insurance companies, or they can insure themselves.  Workers’ compensation insurance coverage is not required for employers in South Dakota.  However, employers who aren’t covered under a workers’ compensation policy can be sued in civil court by injured employees.
